Imagive is committed to the protection of users' personal data (hereinafter, "Data") in accordance with Indian regulations, including the Information Technology Act, 2000, and the rules made thereunder.

This policy describes our rules concerning the protection of Data. In particular, it describes how data is collected and processed, and how users can exercise their rights.

Data Controller

The controller of personal data is Imagive, a company registered in India with its registered office at 1st Floor, Tower-A, UNITECH CYBER PARK, Durga Colony, Sector 39, Gurugram, Haryana 122003.

Types of Data Collected

The data collected on the Platform are those that enable Imagive to identify users directly or indirectly but also those enabling the use of the services offered by Imagive (publication of content and comments, organization of competitions, etc.).

This may include personal data such as last name, first name, email address, mailing address, billing address, phone number, birth date, gender, pictures, or connection data such as the IP address and browser data such as cookies.

Users who communicate the personal data of a third party will have to confirm that they hold the consent of this third party regarding the exploitation by the Platform, the publication and/or the diffusion on the Platform of these data.

Purpose of the Processing

Use of Data for AI Training

Imagive uses anonymized user data for the purpose of improving and training its artificial intelligence systems. All personal data processed for this purpose is stripped of personally identifiable information (PII) and handled in compliance with applicable laws. This ensures that user privacy is fully protected. Users may request deletion of their data, as detailed in the Data Retention section.

Connection to Google/Meta Ad Accounts

Imagive requires access to users' Google and Meta ad accounts to provide its services. This access is granted by the user during the account setup process and is used solely for optimizing advertising campaigns. Imagive ensures that no unauthorized third parties can access this data, and users can revoke access at any time via the Google/Meta security settings page.

The personal data collected on the Platform are used for the following purposes:

  • Registration (creation of the user's account) and user authentication;
  • Establishment and use of the services offered by Imagive;
  • Analysis of the user's account to provide a personalized and satisfactory service;
  • Providing support tools adapted to meet the needs of users;
  • Improvement of the quality of the Platform;
  • Implementation and management of accounting tools;
  • Platform management and user operations;
  • Performing technical operations for commercial purposes;

Consent

Consent for Data Use and Account Connections

By using Imagive's services, users provide consent for the anonymized processing of their data for AI training and ad optimization purposes, including the connection of their Google and Meta ad accounts. Users can revoke their consent at any time by contacting Imagive at legal@imagive.ai or through their account settings.

This Privacy Policy is presented to users upon registration on the platform. By creating an account or subscribing to the newsletter, users explicitly agree to the terms and conditions outlined in this policy.

ANY NAVIGATION ON THE PLATFORM AFTER THE PUBLICATION OF THE PRESENT PRIVACY POLICY IS ACCEPTABLE UNLESS RESERVED.

Data Recipients

The recipients of the personal data collected on the Platform are, in the first place, Imagive.

When it is strictly necessary for the purposes of the processing, the collected data are transferred to our processors and partners which intervene in the provision of our services.

Moreover, your Data can be disclosed to competent authorities, upon demand, for the purposes of judicial proceedings, requests for information from the authorities, or to comply with legal obligations.

Storage Security & International Transfer

Data we collect is stored on Amazon Web Services servers which ensure a high level of security. These servers are located in the Asia Pacific region.

Third Parties Transfer

For the purposes of the service, we may transfer some of your Data to our subcontractors, some of which are located outside India. In that case, we make sure that they are located in a country deemed by the Indian government to have adequate levels of data protection.

Imagive respects user privacy by not sharing data with external third parties for AI processing. All AI models are developed and run internally, ensuring full control over data handling and privacy.

Security

Transmission of your Data via the Internet is secured via an HTTPS connection protected by an SSL certificate (SHA-256 / RSA Encryption). Access to your Imagive account is secured by your username and password which must be strong enough and not shared. For the most sensitive actions, we use a 2-factor authentication system. This is achieved by requiring you to confirm the actions with a 6-digit code received by SMS or generated by a third-party application.

Data Retention Period

The personal data collected by users is retained for a period of one hundred and eighty (180) days from the disabling of access to the services offered by Imagive, except for the data that Imagive would need to keep as evidence, for legal or administrative purposes or in accordance with the legislation in force.

As an exception to the above paragraph, users are informed that:

  • Collected billing data (including user account data on the Imagive billing system) is retained for a period of five (5) years;
  • Invoices associated with user accounts are retained for a period of ten (10) years in accordance with applicable laws;
  • Cookies are retained for a period of thirteen (13) months maximum after their first deposit in the terminal equipment of the user.

Cookies

Imagive and its partners use cookies and tags to distinguish you from other users when using our website. In fact, during the consultation of our platform, information about the navigation of your device (computer, tablet, smartphone, etc.) on our platform/application, are likely to be saved in "Cookies" files installed on your device, according to the choices you have made regarding cookies and which you can change at any time.

What is the Purpose of the Cookies Used on the Platform?

Only the issuer of a cookie is liable to read or modify the information contained therein.
